Arkansas Supreme Court Decision Allows New DNA Testing in Case of the ​“West Memphis Three,” Convicted of Killing Three Children in 1993

On April 18, 2024, the Arkansas Supreme Court decided 4-3 to reverse a 2022 lower court decision and allow genetic testing of crime scene evidence from the 1993 killing of three eight-year-old boys in West Memphis. The three men convicted in 1994 for the killings were released in 2011 after taking an Alford plea, in which they maintained their innocence but plead guilty to the crime, in exchange for 18 years’ time served and 10 years of a suspended sentence.

Colorado shooting suspect James Holmes is set to appear in court Monday for an initial hearing, but the press is already asking what his punishment should be.

Specifically, U.S. cable news has been posing the death penalty question.

But it’s not just TV. Hop online and you’ll see the death penalty possibility raised, if not even championed, by blog and online newspaper reporters.

There are currently three inmates on death row in Colorado. Holmes is in solitary confinement at Arapahoe Detention Center and faces at least 71 charges in the shooting rampage that killed 12 and injured some 58 others.

But the other part of the talking head discussion is whether Holmes is even competent to stand trial — in which case the death penalty question could be a moot point. On CNN, former prosecutor Paul Callan takes that route.

“He may not be even competent enough to enter a courtroom and understand the proceedings, in which case he'll simply be sent to a mental hospital.”
