Denver criminal defense and civil rights attorney David Lane will represent the man accused of fatally shooting 22 people and injuring more than 20 others last month at a Walmart in El Paso.

Lane confirmed the federal appointment Wednesday morning, as first reported by 9News.

“I accepted the appointment because I believe it is an essential component of all of our freedoms that under the Sixth Amendment, anyone charged with a crime is entitled to an attorney, and I will do my utmost to preserve, protect and defend the Constitutional rights of Mr. (Patrick) Crusius,” he told The Denver Post.

Lane declined to comment further.

The Denver attorney has represented suspects in federal criminal court previously, including in death penalty cases.

Prosecutors in El Paso said they planned to pursue the death penalty against the suspected shooter who was targeting Mexicans, according to police. The 21-year-old man of Allen, Texas, will likely face federal domestic terrorism charges for the Aug. 3 mass shooting, but charges have not been filed. He is being held on state capital murder charges.

Lane started his career as a public defender in 1980 in New York City and is now a partner at Killmer, Lane & Newman, LLP in Denver.

Lane represented Miguel Contrera-Perez who was facing the death penalty in connection with the killing of a Colorado prison officer in 2012 . Lane negotiated a plea deal that led to a life sentence. He also successfully represented Edward Montour Jr. who beat a corrections officer to death in 2005 and Juan Quintero who fatally shot a Houston cop in 2006, helping negotiate deals that spared both from the death penalty.

In 2009, Lane told The Denver Post that he represents various kinds of people, but to him it’s not about whether he likes a person but instead is about ensuring there are checks to the government’s actions.
