U.S. Supreme Court halts execution of Cleve "Sarge" Foster

LIVINGSTON, Texas - Cleve Foster, a former Army recruiter who for the third time this year was hours away from his scheduled execution for the rape-slaying of a woman in Fort Worth nearly 10 years ago, was granted yet another reprieve by the U.S. Supreme Court on Tuesday.

The 47-year-old was set to die Tuesday evening in Huntsville.

The high court twice earlier this year stopped Foster's scheduled lethal injection. The latest court ruling came about 2 1/2 hours before Foster could have been taken to the Texas death chamber.

Foster was meeting with one of his lawyers in a small holding cell a few feet from the death chamber when a Texas Department of Criminal Justice spokesman delivered the news.

"He thanked God and pointed to his attorney, saying this woman helped save his life," prison spokesman Jason Clark said.

He also said Foster repeated his insistence that he was innocent.

Unlike his previous trips to the death house in Huntsville, the reprieve came before he was served his requested final meal, which included two fried chickens and a five-gallon bucket of peaches.

Instead, he immediately was returned to death row at a prison about 45 miles to the east.

Foster was one of two men convicted and sent to death row for fatally shooting a 30-year-old woman whose body was found in a ditch by pipeline workers in Fort Worth in February 2002. His partner died last year of cancer.

Every few years, from childhood until my late teens, my granddad would take me along with him to the small Texas town where he grew up—Normangee, population 522—to visit old relatives and even older graves. The drive took us up I-45, beyond the Houston sprawl, past pine forests, and eventually through Huntsville, epicenter of the state prison system. One of the city’s seven prisons was just off the interstate, and as we passed by I’d stare at the guard towers and barbed wire before turning my attention across the street to the Texas Prison Museum, which had its own mock guard towers in the parking lot. (“Prison” and “museum” were words that never seemed to go together.) Later, I learned that the museum’s central attraction was the wooden electric chair the state used for executions until 1964.

The following document is a written record of convicted killer Hamida Djandoubi's last moments before he was guillotined in a Marseilles prison on September 10, 1977. This written record -- dated September 9 -- was written by a judge appointed to witness the execution. Djandoubi's execution was the last execution carried out in France before capital punishment was abolished in 1981. Saudi authorities agree to postpone execution of Kenyan national

NAIROBI, Kenya, May 13 – Saudi Arabia has acceded to Kenya’s request to postpone the execution of Stephen Munyakho that was set for Wednesday to allow for further negotiations between all parties. According to Foreign Affairs Principal Secretary Korir Sing’Oei, Kenya will be engaging stakeholders in Nairobi and Riyadh, including religious leaders, to agree on the next urgent steps.
