Montana: Death chamber's size delays execution

Delays in building a new lethal injection chamber at Montana State Prison have bought some time, perhaps several months or even a year, before the only Canadian on death row in the U.S. will face possible execution. 

A hearing is planned for today to set a date to execute Alberta-born Ronald Smith for murdering two Blackfoot Indian men in the state in 1982. But one of Smith's lawyers said Tuesday that any execution date would have to be ignored after an injunction was granted Monday stating that the death penalty must await the resolution of a lawsuit filed by Smith and the American Civil Liberties Union over the state's proposed new lethal injection facility.
