A 22-year-old former university student facing the death penalty for murdering and burning his pregnant girlfriend's body 2 years ago in Sabak Bernam is now appealing for a reduced sentence.
Lawyer Muhammad Nor Tamrin, representing Muhammad Fakrul Aiman Sajali, said a notice of appeal to review the death penalty was filed at the Court of Appeal through Messrs M. Nor & Partners on Oct 20.
According to court documents, Fakrul Aiman is appealing against the decision of Klang High Court judge Norliza Othman on Oct 15, which found him guilty of murdering his pregnant girlfriend and sentenced him to death by hanging.
Nor told the New Straits Times that Fakrul Aiman is currently held at Kajang Prison.
In her judgment, Norliza had said the seriousness of the offence, described as cruel and premeditated, warranted a harsher sentence compared with a spontaneous act of violence.
She said it was not only the life of the victim that was taken away, but also that of her unborn child, who was 18 weeks in the womb.
The judge had said an autopsy conducted by the Forensic Department of Sungai Buloh Hospital revealed burn marks covering almost the entire body.
She had said even more horrifically, the victim's abdomen was torn open, exposing her intestines and internal organs.
Norliza had said the accused was said to have struck the victim on the head with a stick, causing her to fall, before dragging her to the edge of a drain. He then took a knife from a car before stabbing her in the abdomen and slashing her neck.
Nor, in his mitigation, said his client had been made a scapegoat, citing a DNA testing by the Chemistry Department confirmed that the 18-week-old fetus did not belong to Fakrul Aiman.
On June 1, 2023, Fakrul Aiman was charged at the Sungai Besar magistrate's court with the murder of Nur Anisah Abdul Wahab, 21, at Jalan Sungai Limau, here, between 8.30pm on May 22 and 8am on May 23, 2023.
On May 15 last year, the High Court allowed Fakrul Aiman to be referred to a psychiatrist.
On Sept 29 this year, he maintained his position to change his plea from not guilty to guilty.
It was reported that Fakrul Aiman and Nur Anisah, a waitress, were in a relationship for about a year and had been having arguments to conceal an out-of-wedlock pregnancy.
