Activists Call on President Biden to End the Federal Death Penalty Before Leaving Office

Firdaus Ismail was ordered to be jailed 40 years and given 12 strokes of the rotan instead.

PUTRAJAYA: The Court of Appeal today commuted the death sentence to 40 years in prison for a man who murdered his mother and dumped her body in a septic tank six years ago.

The three-judge panel, consisting of Court of Appeal judges Ahmad Zaidi Ibrahim and Zaini Mazlan and High Court judge Noorin Badaruddin, also ordered Firdaus Ismail to receive 12 strokes of the cane.

In granting Firdaus’s appeal, Zaidi said the court had taken into account the submission by lawyer Hussaini Abdul Rashid for the prison term, and the fact that deputy public prosecutor Roshan Karthi Kayan did not seek to retain the death sentence.

After considering the facts of the case, the court finds the appeal has merit. 

The death sentence is therefore replaced with 40 years in prison, starting from Sept 25, 2018, the date of his arrest, and 12 strokes of the rotan, Zaidi said.

Hussaini informed the court earlier that Firdaus was withdrawing his appeal against conviction.

He said that when the High Court sentenced Firdaus to death in 2022, the Abolition of Mandatory Death Penalty Act 2023 had not yet been enforced.

Firdaus, 35, the youngest of five siblings, was convicted and sentenced to death by the High Court on April 15, 2022, for the murder of his mother, Faridah Mat Hashim, 63, at their house in Balik Pulau, Penang, on Sept 19, 2018.

It was reported that Faridah’s body was found inside a septic tank behind the house.

Public execution in Saudi Arabia (file photo) A Saudi newspaper has carried a film showing the beheading of a man convicted of raping a teenaged boy before murdering him in the heart of the desert. The rare and shocking 51-second film showed the executioner bringing down his sword on the defendant’s head, which was severed in just a split of second. The executioner, a tall man wearing traditional Saudi dishdasha (gown) and ghutra (head cover), then wiped blood off his sword with a piece of cloth after the beheading before walking away from the rapist’s headless body. Sharq newspaper, which published the film, did not say how it was shot as filming of executions in the conservative Gulf kingdom is banned. Newspapers said the unnamed defendant had been convicted of abducting the Saudi boy to a desolate desert area and raping him. India | Supreme Court mulls guidelines to address delays in execution of death row convicts

Expressing concern over the agonising indefinite delays in execution of death row convicts, the Supreme Court has indicated that it’s mulling issuing certain guidelines to address the issue. “Possibly, it is time for us to lay down the procedure as to what the public prosecutor has to do when mercy petitions of convicts against the death sentence are rejected. Frank Amado On October 19, 2009 U.S. Citizen, Frank Amado, was arrested outside of his apartment in Jakarta, Indonesia by BNN (the Indonesian drug enforcement agency) for being in possession of 5.668 grams of Shabu (also known as "Ice") which he was storing at his apartment.
