Texas | Jury picks life in prison over death penalty for former USBP agent Burgos-Aviles in double murder trial

Relatives of Grizelda Hernandez and little Dominic Alexander Hernandez burst into tears upon hearing the sentence of life in prison without parole awarded by the jury in the double murder trial of Supervisory Border Patrol Agent Ronald Anthony Burgos-Aviles on Monday in the 49th Court before Judge Joe Lopez.

Burgos-Aviles was already found guilty on July 6 of murdering his lover Grizelda Hernandez, 27, and their son Dominic Alexander, 1, at Father McNaboe Park on April 9, 2018.

On Monday, Webb County District Attorney Isidro "Chilo" Alaniz presented his closing arguments in the final stage of the punishment phase where he asked the jury to say 'Yes' to the question of whether Burgos-Aviles was likely to be a danger to society and to say 'No' to a sentence of life in prison without parole as they would opt instead for the death penalty.

William Boggs, the defendant's attorney, begged for the life of Burgos-Aviles. He reminded the jury that the defendant -- regardless of their decision -- would die in prison. He also asked them to condemn sin and not the man, and to reflect on their individual decision based on morality.

The jury began deliberating around 3 p.m. and the verdict was given after midnight.

Lopez said that it had been a difficult trial and that he asked that everyone in the courtroom respect the process and the result.

"Ronald Anthony Burgos-Aviles, you have already heard me say the result of the two charges, now it is my turn to give a verdict. After having been found guilty of the two charges, it is my job to pronounce sentence."

Lopez then read the two capital murder charges and the result for each one was term of life without possibility of parole.

"Your sentence will start immediately," Lopez said.

The trial for this case began on June 26, five years after the murders were committed.

More than 20 witnesses including relatives, friends, law enforcement agents and forensic experts were called to testify on behalf of the prosecution.

The testimonies revealed the presence of Burgos-Aviles at Father McNaboe Park the day and time the double homicide was committed, his participation in reporting the crime, the lack of care in preserving the crime scene, and a DNA study that proved him to be the biological father of little Dominic, among other information that helped the jury determine the defendant's innocence or guilt.

After the verdict was given, Alaniz gave a press conference in the Central Jury Room.

Former Florida cop to be executed on same day as 80-year-old Pasco man
