Florida | Pablo Ibar recurre su sentencia a cadena perpetua en EEUU por tres asesinatos

Su abogado considera que los jueces que han intervenido en este caso han cometido «errores» al valorar las pruebas

El abogado de Pablo Ibar ha solicitado al Tribunal de Apelaciones de Florida que revoque la sentencia a cadena perpetua que confirmó el pasado mes de abril contra este ciudadano hispanoestadounidense, que cumple condena en Estados Unidos por tres asesinatos.

La Asociación Pablo Ibar Juicio Justo ha informado este viernes de que su letrado, Joe Nascimento, ha pedido al mismo órgano judicial que confirmó el fallo judicial a cadena perpetua que lo revise y detalle por escrito los argumentos en los que fundamenta su decisión ya que considera que los jueces que han intervenido en este caso han cometido «errores» al valorar las pruebas, según recoge EFE.

En la vista del recurso celebrada por videoconferencia el pasado 28 de febrero el letrado pidió que se revocara la cadena perpetua que actualmente recae sobre Ibar y se celebrara un nuevo juicio. Alegó para ello doce motivos, entre ellos las irregularidades que se cometieron durante el proceso y la supuesta parcialidad en la que incurrió el juez Dennis Bailey, quien dirigió la vista.

Pero el Tribunal de Apelaciones rechazó el pasado 19 de abril estas peticiones sin dar ninguna explicación y únicamente se pronunció sobre la supuesta actuación de parcialidad del juez Dennis Bailey con un miembro del jurado que denunció haber sufrido presiones por parte de sus compañeros para que emitiera un voto favorable a la condena.

Al desestimar sin explicación alguna los otros once motivos se impide que la defensa pueda utilizar estas mismas líneas argumentales en el recurso ante la siguiente instancia judicial, que será en el Tribunal Supremo de Florida, lo que ha llevado al abogado de Ibar a pedir ante el mismo tribunal una nueva audiencia y que «emita una opinión escrita sobre las cuestiones» que no abordó en abril.

Para ello expone los «errores» que se cometieron durante el proceso anterior, ya fuera al aceptar opiniones de determinados testigos, identificaciones en ruedas de reconocimiento sin rigor, que no se interrogara a determinados expertos y los «abusos» en los que incurrió el magistrado que presidió el juicio en 2019, en el que Ibar fue sentenciado a cadena perpetua.

Pablo Ibar, de 50 años, casado, padre de dos hijos y sobrino del boxeador vasco José Manuel Ibar «Urtain», permanece encarcelado en Estados Unidos desde 1994 y ha sido juzgado cuatro veces por las muertes de Casimir Sucharski, dueño de un club nocturno, y de las modelos Marie Rogers y Sharon Anderson, tres crímenes que asegura que él no cometió.

Ibar pasó 16 años en el corredor de la muerte hasta que en 2016 un tribunal de apelación anuló la sentencia al considerar las pruebas «demasiado endebles», y posteriormente su condena a muerte fue sustituida por cadena perpetua.
