Omar Raddad : l’ADN retrouvé sur des scellés n’est pas celui du jardinier

Vingt-cinq ans après, nouveau rebondissement dans l’affaire Omar Raddad. Les empreintes génétiques récemment retrouvées sur trois scellés de l’affaire ne « correspondent» ni avec celles du jardinier ni avec celles des possibles suspects désignés par son avocate, a fait savoir, lundi 10 octobre, le parquet de Nice.

La comparaison de ces traces, retrouvées sur deux portes et un chevron, n’a toutefois pas encore été faite avec le recours du Fichier national automatisé des empreintes génétiques (FNAEG), qui permet de déterminer une éventuelle correspondance avec une personne répertoriée dans ce fichier, a précisé le procureur de Nice Jean-Michel Prêtre.

Ces traces n’ont pas encore non plus été comparées avec les ADN d’autres personnes de l’entourage de la victime pour lesquelles l’avocate d’Omar Raddad, Sylvie Noachovitch, avait ultérieurement demandé aussi un recoupement, a ajouté M. Prêtre au cours d’un point presse. « On va aller au bout du possible » dans cette procédure, a-t-il assuré.

S’appuyant sur la loi du 20 juin 2014 visant à assouplir les critères pour obtenir la révision d’un procès, Me Noachovitch avait demandé et obtenu de la part du parquet de Nice que soient ordonnés de nouveaux prélèvements sur deux portes et un chevron qui se trouvaient sur la scène de crime. C’est sur ces deux portes qu’avaient été écrites avec le sang de la victime les inscriptions « Omar m’a tuer » et « Omar m’a t ».

En novembre 2015, quatre empreintes génétiques correspondant à quatre hommes, deux empreintes parfaitement exploitables et deux autres partiellement, avaient été retrouvées sur ces scellés.

Certains de ces ADN se mélangent avec ceux de Ghislaine Marchal, la victime. Cependant, a rappelé lundi le parquet, le fait que de l’ADN ait pu être mélangé à celui de la victime n’indique pas que cela ait été nécessairement concomitant. Il est possible qu’une empreinte, lors d’une manipulation ultérieure, ait pu être ajoutée à celle de Mme Marchal (voir extrait Wikipédia ci-dessous).

Ghislaine Marchal, alors âgée de 65 ans, une riche veuve vivant à Mougins (Alpes-Maritimes), avait été tuée à coups de couteau le 23 juin 1991 dans sa propriété. Son jardinier, M. Raddad, avait été condamné en 1994 à dix-huit ans de réclusion criminelle, avant de bénéficier d’une libération conditionnelle en 1998, à la suite d’une grâce présidentielle partielle de Jacques Chirac.

D’autres traces ADN ne correspondant pas à celles de M. Raddad avaient déjà été retrouvées sur le lieu du crime, mais la justice lui avait refusé en 2002 un nouveau procès.

Le 10 mai 1996, le président Jacques Chirac accorde une grâce partielle à Omar Raddad, réduisant sa peine de quatre ans et huit mois. Le 2 février 2000, six ans exactement après la condamnation d'Omar Raddad, la Commission de révision des condamnations pénales a ordonné de nouvelles investigations et notamment, une nouvelle expertise d'écriture pour savoir si Mme Marchal est l'auteur des inscriptions « Omar m'a tuer ». Deux experts ont été nommés : Anne Bisotti et Françoise Ricci D'Arnoux. De plus, à la demande de la défense, le 14 janvier 2001, la justice a ordonné une nouvelle expertise sur les portes et sur le chevron de bois ayant servi à frapper Ghislaine Marchal. Sur les trois supports ils découvriront des ADN. Le 20 février 2001, après vérification, les experts ont déclaré que les ADN masculins retrouvés sur les portes de la chaufferie et sur le chevron n'étaient pas celui d'Omar Raddad, sans toutefois être en mesure de préciser à qui appartenaient ces empreintes génétiques, ni leur provenance. En revanche, deux ADN masculins ont bien été retrouvés sur les portes et le chevron, mêlés au sang de la victime (rendant impossible l'hypothèse d'ADN d'enquêteurs). Lire la suite sur Wikipédia.

Defended at his trial by Jacques Vergès, Raddad was convicted 1994, and sentenced to 18 years in prison. Raddad always maintained his innocence. Radded received a partial pardon from French President Jacques Chirac in 1996 at the request of Moroccan King Hassan II, which reduced his sentence to 4 years and 8 months, and was released from prison in 1998. The misspelled sentence "Omar m'a tuer" ("Omar killed me), found written in blood at the crime scene, became a widely used phrase in French society during the 1990s. Florida to execute William Thompson after nearly 48 years on death row

On Sept. 11, Gov. Ron DeSantis issued a death warrant for William Thompson, convicted of the 1976 kidnapping, rape, and murder of 23-year-old Sally Ivester. He had been sentenced to die for the 1996 kidnapping and strangling of Richard Allen Montgomery, whose mutilated body was found in a wooded southwest Florida area where authorities found the remains of at least 6 people over a 3-year span.

Alabama plans to execute Jeffery Lee on Thursday via lethal injection after a down-to-the-wire decision by the federal courts halted his death by nitrogen hypoxia in June. In response, Gov. Iran | Afghan Citizen Executed in Wheelchair Due to Severe Mobility Disability

KABUL, AFGHANISTAN – Iranian authorities have reportedly executed an Afghan citizen, identified as Valijan Nourzay, at the central prison in Rafsanjan, according to the human rights organization Hengaw. Hengaw said in a statement on Sunday, September 6, that Nourzay was executed early Wednesday last week at Rafsanjan Central Prison. According to the organization, Nourzay had a severe mobility disability and was executed while in a wheelchair. Hengaw, citing informed sources, reported that Nourzay had been pursued by Iranian authorities three years ago over an alleged murder. He was reportedly seriously wounded after Iranian security forces opened fire on him in Rafsanjan before being arrested and later sentenced to death.
