Perry Commutes Death Sentence

AUSTIN – Gov. Rick Perry today commuted the death sentence of Kenneth Eugene Foster of San Antonio to life imprisonment after the Texas Board of Pardons and Paroles (TBPP) recommended such action.

On May 6, 1997, Foster was sentenced to death for his role in the 1996 capital murder of Michael LaHood. Foster sought to have his death sentence commuted to a life sentence arguing that he did not shoot the victim, but merely drove the car in which that the actual killer was riding. In addition, Foster was tried along side the actual killer, Maurecio Brown, and the jury that convicted Foster also considered punishment for both him and his co-defendant in the same proceeding.

"After carefully considering the facts of this case, along with the recommendations from the Board of Pardons and Paroles, I believe the right and just decision is to commute Foster's sentence from the death penalty to life imprisonment," Gov. Perry said. "I am concerned about Texas law that allows capital murder defendants to be tried simultaneously, and it is an issue I think the legislature should examine."

The TBPP voted 6-1 to recommend commutation, and the governor signed the commutation papers Thursday morning.

The governor's action means Foster's sentence will be commuted to life imprisonment as soon as the Texas Department of Criminal Justice can process this change.

Oklahoma executes Kevin Underwood by lethal injection for brutal 2006 murder Nearly two decades after Kevin Ray Underwood murdered his 10-year-old neighbor, he died by lethal injection Thursday morning at 10:14 a.m., according to media witnesses. By coincidence, it was his 45th birthday. Underwood was sentenced to death in 2008 for killing Jamie Bolin in Purcell two years earlier. He confessed to police that he lured Bolin into his house, beat her over the head, attempted to decapitate her and stashed her body in a plastic tub with hopes of later eating it.

OKLAHOMA CITY (AP) — An Oklahoma panel on Friday rejected a plea for clemency for a man convicted of torturing and killing a 10-year-old girl as part of a cannibalistic fantasy, paving the way for him to become the 25th and final person executed in the U.S. this year. Three members of Oklahoma’s Pardon and Parole Board voted unanimously against clemency for Kevin Ray Underwood, who is scheduled to receive a lethal injection on Thursday, his 45th birthday.  An Indiana man, Joseph Corcoran, is set to die Wednesday for killing four men in 1997 in what would be the Hoosier State’s first execution in 15 years.

Indiana carries out first execution in 15 years An Indiana man convicted in the 1997 killing of four people including his brother and his sister’s fiancé was put to death on Wednesday in the state’s first execution in 15 years. Joseph Corcoran, 49, was pronounced dead at 12:44 a.m. CST at the Indiana State Prison in Michigan City, Indiana, according to the Indiana Department of Correction, making it the 24th execution in the U.S. this year. He was scheduled to be executed with the powerful sedative pentobarbital, although officials did not mention that drug in their statement.

China on Tuesday executed a former official for corruption, a court in the northern region of Inner Mongolia said, the latest development in Beijing’s sweeping campaign against graft. Li Jianping, former secretary of the Communist Party working committee of the Hohhot economic and technological development zone, had previously been sentenced to death for crimes including bribery and misappropriation of public funds.

Zephen Xaver, 27, appeared to gulp but otherwise showed no emotion as Judge Angela Cowden pronounced the sentence at the Highlands County Courthouse in Sebring. At gunpoint, Xaver ordered his victims, all women, to lie on the floor and then shot each the head as they begged for mercy.
