Harold Nichols and Oscar Smith are now set to die on June 4 and Aug. 4, respectively
The Tennessee Supreme Court has set 2020 execution dates for 2 men, putting them in line behind Nick Sutton, who is set to be executed on Feb. 20.
Oscar Smith, who was sentenced to death in Nashville for the 1989 murders of his estranged wife Judy Smith and her 2 sons, Chad and Jason Burnett, is due in the death chamber on June 4.
Harold Nichols, who was convicted in Chattanooga for the 1988 rape and murder of Karen Pulley — and has also been convicted for a series of other rapes — is set to be executed 2 months after that on Aug. 4.
Smith and Nichols are 2 of the 9 men for whom Tennessee Attorney General Herbert Slatery is seeking execution dates.
Attorneys representing those men have raised a number of arguments as to why they should not be executed, including mental illness and racism that infects the death penalty process.
Smith's attorneys cite a biased jury, among other issues with the case against him, in arguing that he was denied a fair trial.
"Mr. Smith has maintained his innocence from the beginning," says assistant federal public defender Kelley Henry, who represents Smith. "We recently learned that at least 2 jurors who voted to sentence Mr. Smith to death mistakenly believed that a life sentence meant a mere 13 years in prison. We will explore all options on Mr. Smith’s behalf."
If all 3 executions scheduled for this year proceed, Smith and Nichols would be the 8th and 9th men executed in Tennessee since the state resumed executions in Aug. 2018.
